Erstad & Riemer, P.A.’s workers’ compensation department traditionally represents insurance companies, third-party administrators, self-insured employers, and uninsured employers in all aspects of workers’ compensation litigation. Most members of the department practice exclusively in workers’ compensation defense.
Our lawyers take a preemptive approach to dispute resolution. We often assist claims persons with the initial liability decisions, defense strategy prior to actual litigation, and choice of medical experts. Our goal is to assist the client in identifying the most cost-effective strategy for resolving claims. We use alternative dispute resolution methods, including mediation.
We are also ready for trial. We have successfully litigated thousands of cases and appear regularly before the Department of Labor and Industry, the Office of Administrative Hearings, the Workers’ Compensation Court of Appeals and the Minnesota Supreme Court. We handle cases from inception to trial and through the appeal process.

We are experienced in all aspects of workers’ compensation litigation, including coverage issues, jurisdictional defenses, liability determinations, medical disputes, rehabilitation/retraining disputes, multiple injury claims and apportionment, contribution claims, subrogation, coordination of benefits, and permanent total disability claims. We also assist our clients with seeking reimbursement from the Worker’s Compensation Reinsurance Association, Special Compensation Fund, and Second Injury Fund. We can handle any workers’ compensation dispute.
